§ 35.103 Relationship to other laws

(a) Rule of interpretation. Except as otherwise provided in this part, this part shall not be construed to apply a lesser standard than the standards applied under title V of the Rehabilitation Act of 1973 (29 U.S.C. 791) or the regulations issued by Federal agencies pursuant to that title.
(b) Other laws. This part does not invalidate or limit the remedies, rights, and procedures of any other Federal laws, or State or local laws (including State common law) that provide greater or equal protection for the rights of individuals with disabilities or individuals associated with them.
What § 35.103 Means in Practice
- Complying with Title II does not automatically mean you comply with Section 504 or state disability laws
- Where Section 504 is stricter, Section 504 controls
- State laws may impose additional requirements. Entities must check their state's disability rights laws
- This section prevents entities from using Title II compliance as a shield against other applicable laws
Common Questions
If we comply with Title II, are we automatically compliant with Section 504?
Not necessarily. Section 504 has its own requirements, particularly for entities receiving federal financial assistance. Both must be independently satisfied.
Do state accessibility laws matter?
Yes. Some states have stronger disability rights laws than the federal ADA. Check your state's laws in addition to Title II.
